This note has been updated to include the changes made to the consenting provisions of the RMA as a result of the Resource Management Amendment Act 2020 (RMAA20). For more information about the amendments refer to the RMAA20 - Fact Sheets available on the Ministry for the Environment's website.
There are two types of notified resource consent applications:
-
Publicly notified applications - allows any person (other than a trade competitor) to lodge a submission in support and/or opposition, or to indicate a neutral position with respect to an application; and
-
Limited notified applications - notice of the application is served on all persons identified as being adversely affected and allowing only those persons to lodge a submission. However, where affected parties have provided their written approval they are not served notice and cannot lodge a submission.
Section 2AA of the Resource Management Act 1991 (RMA) provides definitions relating to both public and limited notification. Section 2AB sets out requirements for giving public notice of an application. Section 2AC sets out how documents are to be made available to the public.
