The figure shows the process used when issuing an excessive noise direction, which starts with an excessive noise direction being issued to the occupier (either written or oral means). The duration of the direction is 72 hours or less. There may either be:

• Immediate compliance.
• No occupier, in which case either:
  • Leave a written notice
  • Accompany a constable (or direct a constable) to enter the premises, seize the instrument, render it inoperable, and lock or seal the building.
• A failure to immediately comply; in which case:
  • Accompany a constable (or direct a constable) to enter the premises, seize the instrument, render it inoperable, and lock or seal the building.
  • Charge the occupier of an offence under 338(2)(c). Maximum penalty $10,000, continuing offence a maximum $1,000 per day.
