Section 32 Analysis

Section 31(2) of the RMA Amendment Act 2003 states that the methods used to carry out any of the other listed territorial authority functions may include the control of subdivision.
This section requires an "evaluation". This evaluation:
- Must examine the extent to which each objective in a plan is the most appropriate way to achieve the purpose of the RMA, and whether, having regard to their efficiency and effectiveness, the policies, rules or other methods are the most appropriate way of achieving the objectives.
- Must take into account the benefits and costs of policies, rules or other methods and the risk of acting or not acting if there is insufficient information about the subject matter of the policies, rules or other methods.
