Land Transport Legislative Framework

This figure is a flowchart of Land Transport Legislative Framework.

The top level of the framework consists of the Resource Management Act 1991, the Land Transport Act 1998, and the Local Government Act 2002. Beneath this level are National Policy Statements/National Environmental Standards, the National Land Transport Strategy, and Regional or Smart Growth Strategies. These are regulatory or non-regulatory instruments that can be prepared to give effect to each of the respective Acts that form the legislative framework. National Policy Statements and National Environmental Standards, in turn, can be used to inform the content of the National Land Transport Strategy.

At the next level are Regional Policy Statements and Regional Land Transport Strategies. Regional Policy Statements are required to give effect to National Policy Statements and National Environmental Standards. Regional Land Transport Strategies need to be consistent with Regional Policy Statements and regional and district plans. Regional Policy Statements and Regional Land Transport Strategies can also be influenced by Regional and Smart Growth Strategies.

The final level consists of Regional Plans, District Plans and Long Term Council Community Plans. Regional and district plans are required to give effect to National and Regional Policy Statements and to have regard to Long Term Council Community Plans and Growth Strategies. Long Term Council Community Plans can help to inform the content of regional and district plans and other strategies (eg, reserve management plans) and to help fund supporting non-regulatory programmes.
