Text description of flowchart

Once the council has decided to review consent conditions (section 128):

  1. The council serves a notice of review consent on the consent holder (section 129).
  2. If the consent holder is invited to propose new conditions they have 20 working days to do this (section 129(1)(d)).
  3. Once conditions are received, or if the consent holder has not been invited to propose new conditions, the council assesses whether to publicaly notify, serve notice or non-notify the review ( section 130(3),95-95F):
    • If the review is non-notified, a decision must be issued within 20 working days (section 131 and 132).
    • If the decision notified/ serviced (section 131) then the timeframes and processes under section 96-102 and sections 117 (4),(6)-(8) with respect to restricted coastal activities apply, and a decision is issued (section 131 and 132).
  4. After the decision is issued, appeals and objections may be lodged (section 132) and the timeframes of section 120 and 121 apply.
